At the debate in the Serbian parliament Malovic said that the new laws will define war and organised crime prosecutors as special jurisdiction prosecutors’ offices.
She added that basic, higher and appellate prosecutors will also have special jurisdictions.
Malovic noted that public prosecutors will be appointed by parliament, at the government’s recommendation, for a period of six years, adding that the position of the deputy public prosecutor will in future become a permanent one, after the first three-year mandate period.
The executive and legislative authorities must not have any influence on public prosecutors and their deputies, she added, noting that in case of unconscientious or incompetent performance, prosecutors and their deputies may be publicly reprimanded, fined or prevented from promotion for a period of three years.
The Minister explained that the state prosecutors’ council will take over a portion of the responsibilities of the High Judicial Council and become an independent organ, tasked with ensuring the independence of prosecutors.
