Speaking at the opening of the conference themed “Enforcement Procedure – Serbia and Neighbouring Countries”, Petrovic said that these were all legal sentences which were not executed, wherefore the persons sentenced to prison never served their time nor will they in future because the procedures are now obsolete.
Petrovic noted that this must be rooted out and announced amendments to the Law on enforcement proceedings because efficient enforcement procedure is the crown of the court procedure.
Our aim is a fair, independent and efficient judiciary and we will attain it through the huge reform which is underway and should enable the formation of new institutions, such as the Supreme Court, courts of appeal and the Constitutional Court, said Petrovic.
Apart from obsolete criminal cases and execution of sentences, Petrovic also criticised mild penal policy.
Failure to enforce court sentences prevents citizens from exercising their rights, he said and added that it is not possible to get serious investments and develop the economy if the country does not have an enforcement procedure which enables the trustees to collect their claims.
Economy Advisor to the Serbian Prime Minister Milan Parivodic said he proposed that preambles be introduced in all regulations.
It is essential to know the aim of an adopted regulation as regulations are often interpreted literally, said Parivodic.
US Ambassador to Serbia Cameron Munter said that the US government has set aside $9.4 million for technical assistance to the Serbian government with the aim of creating a more favourable environment for investments, including assistance and aid for the development of an efficient system for enforcing court decisions.
We will remain with Serbia while it undergoes all the challenges which accompany the transition process with the belief that you will fulfill all the EU integration standards, stressed Munter.
