Opening a round table discussion on the draft law on the Serbian Constitutional Court, Petrovic explained that the very day this law is passed parliament could select judges of the Constitutional Court.
According to Petrovic, the most important novelty envisaged by the new law on the Constitutional Court is the institute of constitutional appeal, which did not exist until now in constitutional defence practice in Serbia.
Citizens will have the opportunity to turn to the Constitutional Court, if there is no other way to get court protection, and if cases last too long, said Petrovic.
Deputy Secretary of the Venetian Commission Thomas Markert said that adoption of this document will allow the establishment of an independent system of constitutional defence, in harmony with modern European standards.
He said that an expert group of the Serbian Ministry of Justice, which worked on the drafting of this law, upheld several objections made by the Venetian Commission, including the suggestion that it should be possible for president of the Constitutional Court to be reelected.
Head of the OSCE Mission to Serbia Hans Ola Urstad said that the Justice Ministry has done an excellent job and the law will provide constitutional protection of the highest European standard.
