Secretary-General of the Secretariat for implementation of the strategy for judiciary reform Milan Skulic said today that adoption of the new Law on criminal procedure, which strengthens the role of investigation procedure, marks the beginning of the reform of the judiciary system, in which process prosecutors should take an active role.

Speaking at a conference called "Presentation of the German model of organisation of public prosecutor's office - the relationship between the Ministry of Justice and public prosecutor's office", Skulic said that the reform of the Serbian legal system will largely contribute to greater efficiency of the criminal procedure. He added that the state is resolved to create conditions for a stronger role for the prosecution and improve it in terms of personnel and technical equipment.
German Public Prosecutor Jurgen Den said that the public prosecution is obliged to press criminal charges in accordance with the law and in cases where a crime is to be proven.
He recalled that the public prosecution is recognised as judicial body but noted that discussions are still underway on its role in modern criminal proceedings. The professional literature refers to it as an “incomplete organ”, which gets its contours only on regular confrontation with the court and police, he explained.
According to him, Germany does not have a special law regulating the position of public prosecutors and official surveillance is done by the Ministry of Justice.
Some 130 representatives of municipal, district and state public prosecutor’s offices participated in today’s conference organised by the Serbian Ministry of Justice in cooperation with the EU’s Twinning Project.
