Speaking at an international conference in Rome themed “Shaping judicial councils to meet new challenges”, Popovic underlined that the establishment of a judicial council is a strong guarantee of judicial independence and the basis for its institutional reform, as it protects the basic principles of the separation of power – balance and accountability.
The Minister of Justice presented constitutional solutions for the composition of the High Judicial Council, the position of its members and the manner of their election, the role and authority of this council, as well as mechanisms that will enable efficient exercise of its competencies.
Constitutional reform is just the first step, and there cannot be real reform towards the strengthening of the judiciary and the rule of law without quality judicial laws, the Minister of Justice underlined in her speech, and announced further work on their adoption.
The international conference, organised by the Venice Commission in association with the Sapienza University of Rome and the University of Barcelona, was opened by Italian Minister of Justice Marta Cartabia and Special Representative of the Venice Commission Gianni Buquicchio.
The conference aims to find an appropriate balance between independence and accountability of judicial councils, through an analysis of national legislations of member states of the Council of Europe and solutions related to their composition, election of members and the duration of their mandates.
