The Ministry of Justice stated today that Council of Europe’s GRECO published the Second Compliance Report for the Republic of Serbia in Serbian and English.
The Ministry has published the mentioned report guided by the principle of transparency, in accordance with the GRECO regulations.
In this reporting period, concrete progress has been made compared to the previous Interim Compliance Report from 2019, with two recommendations now fully implemented, ten partially and only one remaining unfulfilled.
In the previous reporting period, none of the recommendations were fully implemented. Despite the evident progress since the adoption of the Interim Report, GRECO's overall conclusion currently states a globally unsatisfactory assessment of compliance, given that a significant number of recommendations have been partially met (a total of 77% of all GRECO recommendations have been partially implemented).
However, the report states that the constitutional amendments are the predominant reason for that, and that Serbia will only be able to fulfil certain parts of GRECO's recommendations only after these amendments enter into force.
Respecting the constitutionally prescribed procedure for amending the highest legal act of Serbia in accordance with Article 203 of the Constitution of the Republic of Serbia, the Ministry of Justice is making significant efforts to fully comply with international standards.
This especially refers to strengthening the rule of law and guaranteed division of power, ensuring that the relationship between the three branches of government is based on mutual restriction and balance, the statement explains and adds that the Venice Commission positively assessed the proposed amendments to the Serbian Constitution.
