The Ministry of Justice welcomed today the publication of the Urgent Ex-post Opinion of the Venice Commission of the Council of Europe on the Draft Law on the Judicial Academy, which confirmed that the Republic of Serbia has implemented both key recommendations from the Commission’s previous opinions.

Key recommendations of Venice Commission on Draft Law on Judicial Academy implemented

The Venice Commission assessed that the first key recommendation from the 2024 Opinion, which relates to a more precise regulation of the competences of the High Judiciary Council and the High Prosecutorial Council in relation to the Judicial Academy, including supervision of its work, the procedure for reviewing the results of the entrance exam and the exercise of their constitutional competences, has been implemented.
The Commission indicated that certain issues could be further developed normatively, but explicitly stated that this key recommendation have been implemented.
At the same time, the Venice Commission confirmed that the second key recommendation from the 2024 Opinion, which concerns the removal of the Minister of Justice from the Governing Board of the Judicial Academy, has been fully implemented.
The Commission welcomed the new legal solution and assessed that it fully complies with its previously issued recommendations.
