Samardzic told a press conference yesterday that the assembly is the result of the citizens’ will voiced at elections held on May 11 and added that at this moment nothing is more natural than to form a joint body to amalgamate the work of local organs in Kosovo.
The municipal assembly is the best way to achieve this as it will unite and coordinate local organs and represent all citizens in the province who acknowledge Serbia as their state, he explained.
According to him, this will show that the Serbian community has no intention of engaging in conflicts, but that it wants to lead its life in accordance with international law and the Serbian Constitution.
Having noted that the formation of this body is related to the promulgating of the Kosovo constitution, Samardzic said that Serbs in Kosovo, the state of Serbia and non-ethnic Albanians do not recognise the province’s independence, the act of secession and the Kosovo constitution.
He reiterated that Serbia does not accept the Kosovo constitution, which came into force yesterday, and that it considers it null and void and legally non-existent.
Kosovo Serbs and representatives of other non-ethnic Albanian communities will not be guided by the Kosovo constitution and it will be valid only for those who accept it of their own will.
According to him, the Kosovo constitution was written in an office far away from Pristina and far away from Kosovo Albanians, as well as the 40 laws which are to be incorporated in this document.
Samardzic also said that UN Secretary General Ban Ki-moon has tried to reconfigure UNMIK, without UN Security Council consent, to which Serbia and some Council members are opposed.
The idea to legalise the EULEX mission in Kosovo is unacceptable because its mandate was projected in Martti Ahtisaari’s plan – a document which was never adopted and which from the point of view of international law is null and void, recalled the Minister.
