It is recalled in the statement that for the purpose of resolving legal ambiguities in connection with the privatisation of the RTB Bor Group, the Serbian government at its session held on July 5, requested the opinion of the Serbian Secretariat of Legislation on the status of the privatisation tender for RTB Bor Group.
The report by the secretariat states:
“The Serbian Secretariat of Legislation is acquainted with the opinion which the Ministry of Economy gave regarding this question on April 23, 2007 (act number 023-02-116/2007-01), according to which consequent to termination of contract with the top ranked bidder only a new sale is possible through a public tender.
The Serbian Secretariat of Legislation considers that this opinion of the Ministry of Economy is based on a correct interpretation of our rules which regulate privatisation through public tender. The public tender ended with the conclusion of the sale contract. Termination of contract took place after the tender was closed. Therefore the only possible course of action after the termination of the contract is to announce a new public tender,” concludes the report.
In keeping with this opinion of the Secretariat of Legislation, the Privatisation Agency will, in accordance with its authority, close the privatisation tender for RTB Bor Group and announce a new tender in the shortest possible period, reads the statement.
