At a seminar on application of the Law on mortgage organised by the Institute of Economic Diplomacy, Parivodic said that past laws were inadequate since they envisaged the possibility of mortgaging only registered real estates.
According to Parivodic, the new law, which has recently come into force, envisages the possibility of mortgaging unregistered immovables and buildings under construction.
The minister stressed that, according to expert predictions, the new Law on mortgage should reduce the cost of loans in Serbia and increase housing construction.
Parivodic said that so far mortgage loans in Serbia have been settled in two phases – through legal proceedings and execution of warrant, both of which were too long and too minutely regulated. The new law will change and speed up these processes.
Instead of lasting for years, the new Law on mortgage envisages selling of a mortgaged real estate to settle debt to a bank in only three to six months.
Another novelty in the Law on mortgage is formation of the Central register of mortgages, which will be managed by the Serbian Geodetic Institute. Central register will prevent putting several mortgages on one real estate.
