No demands by European Commission to repeat election of judges

The Ministry of Justice stated today that an item published today in Vecernje Novosti titled “New election of judges sought” makes incorrect and ill intentioned statements.
The European Commission has not made any demands for repeating the election of judges or to annul the High Judicial Council decision made on 25 December 2009 concerning the termination of duties of all judges who did not get elected.
It is true that on 26 May, at an initiative by the Ministry of Justice, a meeting was held with European Commission representatives, which was also attended by representatives of the High Judicial Council and the State Prosecutorial Council.
Talks were exhaustive and constructive. The Vecernje Novosti article falsely states that there was unpleasantness at the meeting.
It was agreed at the meeting that appeal proceedings initiated by the judges will go ahead and that the decision of the Serbian Constitutional Court will be upheld.
A joint committee of the European Commission and the Justice Ministry will work on the improvement of and further reform of the judicial system, including not just personnel changes but changes to organisation and procedures as well.
European Commission representatives will present suggestions concerning the reform process, will advise Serbian state bodies responsible for fighting against organised crime and corruption and provide guidelines for improving cooperation with the judicial department of EULEX. The Justice Ministry is satisfied with talks with the European Commission and is very clearly committed to respect all agreements.
Without entering into a discussion of possible motives for publishing incorrect information, it can be concluded that these statements are ill intentioned.
Publishing falsehoods related to the judicial reform process is in fact an attempt at undermining the fight against organised crime which is proving successful.
This and similar attempts will certainly not affect the efforts to complete judicial reforms, one of the most important reform processes, which is also a vital element of European integration.
The Justice Ministry will continue to meet its obligations related to the European partnership and European Commission recommendations and will actively take part in Serbia’s EU accession process, concludes the statement.
