Loncar told Beta news agency that considering the fact that the Commission analysed the Constitution after it was adopted and enforced, some of the suggestions can be accepted when Serbia’s constitutional and legal system is rounded up, which follows as a consequence of adopting the new Constitution.
The text of the Constitution cannot be changed, the Minister explained and added that the Constitution is not applied directly as most constitutional provisions are applied through laws.
Speaking on the position of Kosovo-Metohija in the new Constitution, Loncar said that considering Resolution 1244, we were not entitled to work out Kosovo-Metohija’s substantial autonomy as it would be violation of the Resolution.
The agreement that would be adopted in Kosovo-Metohija negotiations could be incorporated in the Constitution through the Constitutional Law which is adopted under the same procedure as the Constitution and is of same legal power, Loncar said.
