The electoral process begins with the calling of elections and concludes with the constituting of the National Assembly and the Government. It is therefore of the utmost importance that the democratic legitimacy gained through the elections be upheld via the institutions and processes established by the Constitution and the law.
Until new governing bodies are elected, the existing authorities continue to exercise their competencies in accordance with their legal powers and limitations. Consequently, no one may unilaterally assume these competencies or demand that decisions be made outside of established procedures.
The Government of Serbia emphasises that the professionalism of the police, media freedom and editorial independence must be safeguarded at all times, including during the transition of power.
While citizens and political actors have the right to call for personnel changes, decisions regarding appointments and dismissals may be made exclusively by the competent authorities, in accordance with the law. Violence, threats and intimidation of employees cannot serve as a means to achieve political demands, nor do they help preserve a democratic society.
The Government expresses its confidence in the lawful and impartial work of the Republic Electoral Commission (RIK) and points out that representatives of electoral lists, including the Student List, participate in the work of electoral bodies in accordance with the law. This enables them to directly monitor the electoral process and adherence to legally prescribed deadlines, while all electoral activities are also continuously observed by representatives of ODIHR.
Furthermore, the Government of Serbia welcomes the fact that representatives of the Student List have publicly, clearly and unequivocally called upon their supporters to refrain from any form of violence, to respect state institutions, and to ensure a peaceful, dignified and lawful transfer of power, in accordance with the election results.
A peaceful transfer of power is a fundamental principle of a democratic order and must take place strictly in accordance with the Constitution, the law, and the electoral will of the citizens as expressed. Anything else would plunge Serbia into instability and call the electoral process itself into question. The Government expects all competent authorities to protect the safety of citizens, public order and peace, and the unimpeded functioning of institutions, professionally, impartially and in accordance with the law, because no one is, or may be, above the law, yet no one may be left outside the scope of its protection either.
Within the scope of its constitutional and legal competencies, the Government in a caretaker capacity, will continue to ensure the continuity of the work of state bodies and the fulfillment of all obligations toward citizens until a new Government is elected.
Furthermore, the Government calls upon the Student List to, in line with its responsibilities, contribute to the preparations for the constitution of the National Assembly, the formation of new government bodies, and a peaceful institutional transition.
The Government urges all citizens not to succumb to provocations and to contribute, through responsible conduct, to the preservation of peace, stability, and mutual respect.
