Government supports draft law on exercise of rights from Alimony Fund

The Serbian government adopted today the Opinion on the Draft Law on the Exercise of Rights from the Alimony Fund, submitted to the National Assembly by Ana Brnabić, deputy of the “Aleksandar Vučić – Serbia Must Not Stand Still” Parliamentary Group and Speaker of the National Assembly of the Republic of Serbia.

The government has thus strongly supported the Draft Law, following the responsible policy of President of the Republic of Serbia Aleksandar Vučić, on the basis that the proposed law provides for the establishment of an Alimony Fund, which will ensure that a child receives support from parents or other persons who are financially responsible for him or her in the future.

The legal solution regulates the establishment and method of financing the Alimony Fund, its management, as well as the child's right to temporary maintenance from the Alimony Fund and other issues of importance for the exercise of this right.

It is envisaged, among other things, that the right to temporary maintenance from this fund may be exercised by a child who is a citizen of the Republic of Serbia and has the status of an enforcement creditor in an enforcement procedure initiated for the exercise of the right to legal maintenance.

With the proposed law, the Republic of Serbia fulfils its obligation under the Convention on the Rights of the Child by prescribing appropriate measures with the aim of providing temporary financial support to the child, in the form of temporary maintenance, in cases where the parent or other relative of the child does not fulfil the maintenance obligation determined by the enforcement document, and the forced collection procedure cannot be implemented because the debtor does not have property or it takes time to settle the due claim for the child's legal maintenance from the property.
