In an interview to the Beta news agency, Malovic announced that the High Judicial Council could be elected early in February, before the legal deadline, while in March the complaints of judges that were not re-elected will be contemplated.
The decisions on the re-election of judges will be reviewed after the adoption of a Rulebook on the criteria and terms, she explained, adding that talks with the judges who filed complaints may be conducted in June.
These judges will be summoned before the High Judicial Council and will be given an opportunity to speak out if they are dissatisfied with the decision. They will also have a possibility to file a complaint to the Constitutional Court, the Minister added.
She stated that European experts will also take part in the drafting of a Rulebook on the criteria and terms, explaining that they will arrive in Belgrade in mid-January. With the consent of the European Commission, an action plan for implementing judicial laws, adopted at the end of December, will also be composed.
The adopted amendments to judicial laws will clear away any doubts as to the general election of judges and convince the public that the High Judicial Council and the State Prosecutors’ Council have made the right decisions, she noted.
Malovic underlined that when resolving the complaints filed by the non-elected judges, the High Judicial Council will adhere to the principles pointed out by the Constitutional Court.
This issue must be resolved and concluded, she highlighted, adding that this is only one element of the judicial reform, along with amendments to the processing laws and the organisation and work of courts and prosecution.
By March the Parliament will be forwarded proposed amendments to the Law on the criminal procedure, she announced, adding that amendments to the Law on legal proceedings are under way, while the law on mediation will be in parliamentary procedure in January.
Preparation of replies to the European Commission’s questionnaire is also under way and this matter will be concluded within the deadline in order to enable the continuation of the EU integration process, she added.
In line with the extradition agreements regarding Serbian nationals, which Serbia signed with Croatia and Montenegro, several dozen persons accused of the severest crimes have been extradited, Malovic announced.
This agreement will also be signed with Bosnia-Herzegovina as soon as the Federation removes obstacles on this path, she concluded.
