Stojkovic said that from now on the basic criterion for the selection of magistrates will be their efficiency and the number of cases solved, because during 2006 a transformation of the magistrate court system is to take place.
He recalled that the recently adopted Law on offences will become effective on January 1, 2006, while the municipal bodies dealing with misdemeanours will be transformed into magistrate courts as of January 1, 2007.
According to Stojkovic, based on that solution, magistrates will be made equal to all other judges, they will be recommended by the High Judiciary Council and elected by the Serbian parliament.
He said that it is his wish that the majority of magistrates remain in their positions, and added that the work of these types of courts is of great importance for citizens since most of their experiences are likely to occur there.
Stojkovic said that the new solution envisages different systemisation, according to which first degree offence proceedings will be conducted in the magistrate court, and second degree offences in a higher magistrate court. He added that magistrate courts will pass sentences, approve bail, and issue warrants for detention.
